Terms & Conditions

1. Definitions
In these Terms and Conditions, the following terms have the meanings given below:
- "Agreement" means these Terms and Conditions together with any written booking confirmation or engagement letter issued by us.
- "Offerings" means the archival education workshops, household inventory programmes and institutional consulting engagements provided by Legacy Loom.
- "We", "Us", "Our" means Legacy Loom, operating from Unit 12-2, Menara Seri Anggerik, Jalan Raja Laut, 50350 Kuala Lumpur, Malaysia.
- "You", "User", "Participant" means any individual or organisation that enquires about, registers for, or participates in an Offering.
- "Content" means the educational materials, templates, guides, documents and other materials we provide as part of an Offering.
- "Fee" means the price stated for each Offering as published on this website and confirmed in writing.
2. Acceptance of Terms
By submitting an enquiry form, registering for a workshop or programme, or entering into an institutional consulting engagement, you confirm that you have read and agree to be bound by these Terms and Conditions.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are registering on behalf of an organisation, you represent that you have authority to bind that organisation to this Agreement.
These Terms apply to all Offerings whether delivered in person, by correspondence or remotely.
3. Service Description and Scope
Legacy Loom provides archival education and operational consulting only. Our Offerings cover the gathering, indexing, description and preservation of documents, photographs and objects. They do not include:
- Valuation of any item for any purpose
- Legal advice on inheritance, estate administration or ownership
- Financial or investment advice
- Administration or distribution of estates
- Probate or conveyancing services
Where questions of this nature arise, we will direct you to the relevant category of qualified professional. We do not recommend individual practitioners.
4. Your Responsibilities
You agree to:
- Provide accurate information when enquiring or registering
- Attend sessions at the agreed time and location
- Engage with the Content and materials in a manner consistent with their educational purpose
- Use the Content only for personal, household or institutional archival purposes and not for commercial redistribution
- Comply with all applicable Malaysian laws in your use of our Offerings
You must not use our Offerings to facilitate any unlawful activity, including any activity that would infringe the rights of a third party.
5. Intellectual Property
All Content — including workshop slides, printed guides, accession sheet templates, inventory templates, photography guides and written materials — is the intellectual property of Legacy Loom. We grant you a limited, non-exclusive, non-transferable licence to use the Content for personal or organisational archival purposes.
You may not reproduce, distribute, adapt or create derivative works from the Content for any commercial purpose without our prior written consent.
6. Fees and Payment
Fees are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated. Current fees:
- Family Archive Starter Workshop: RM 480 per person
- Household Inventory and Documentation Programme: RM 1,930 per household
- Institutional Family Archive Consulting: RM 4,580 (core scope); travel and out-of-pocket expenses agreed separately in writing
Payment is due in full before the commencement of a workshop or programme. For institutional consulting engagements, a payment schedule is agreed in writing before work begins.
6.1 Cancellation and refunds — workshops and programmes
Cancellations made fourteen or more days before the session date will receive a full refund. Cancellations made between seven and thirteen days before the session date will receive a fifty percent refund. Cancellations made less than seven days before the session date are not eligible for a refund, but you may transfer your place to another person by notifying us in writing.
6.2 Cancellation — institutional engagements
Cancellation terms for institutional engagements are set out in the individual engagement letter. Where no specific terms are stated, work completed to the date of cancellation will be invoiced at a pro-rata rate of the total Fee.
7. Offering-Specific Terms
7.1 Workshops
Workshops are capped at twelve participants. We reserve the right to reschedule a workshop where fewer than four participants are registered, giving at least seven days' notice. In this case, participants may transfer to the rescheduled date or receive a full refund.
7.2 Household Programme
The programme runs for six weeks with two-hour weekly sessions. Sessions are delivered in person at our premises unless an alternative arrangement is agreed in writing. Independent work between sessions is a necessary part of the programme; we do not adjust the programme structure for participants who do not complete the independent work.
7.3 Institutional Consulting
The scope of each institutional engagement is set out in a written engagement letter agreed before work begins. Changes to the scope require written agreement from both parties. Travel and out-of-pocket expenses are billed at cost against pre-agreed estimates.
8. Disclaimers
Our Offerings are provided for educational and operational purposes. We make no representation that participation in a workshop or programme will produce any particular archival outcome, or that the systems and tools introduced will be suitable for every collection or situation.
Nothing in our Offerings constitutes legal, financial, tax or valuation advice. We are not responsible for decisions made by participants or clients in reliance on information shared in our sessions. Substantive questions of this nature should be directed to a qualified professional.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, our total liability to you for any claim arising from an Offering shall not exceed the Fee paid for that Offering. We are not liable for indirect, consequential, special or punitive damages of any kind, including loss of data, loss of profits or loss of business.
This limitation does not apply to liability for death or personal injury caused by our negligence, or to any other liability that cannot be excluded by law.
10. Indemnification
You agree to indemnify and hold harmless Legacy Loom and its staff from any claim, loss, damage or expense (including legal costs) arising from your breach of this Agreement or your misuse of the Content.
11. Termination
We may suspend or terminate your participation in an Offering without refund if you breach these Terms, engage in conduct disruptive to other participants, or engage in conduct that is unlawful.
You may withdraw from a workshop or programme subject to the cancellation terms in Section 6. Sections 5, 8, 9, 10, 12 and 13 survive termination of this Agreement.
12. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising under this Agreement.
Before commencing legal proceedings, the parties agree to attempt to resolve any dispute through direct written communication. If a dispute is not resolved within 30 days of written notice, either party may pursue the matter through the courts of Malaysia or, by mutual agreement, refer it to mediation.
13. General Provisions
Entire agreement: This Agreement constitutes the entire agreement between us regarding its subject matter and supersedes all prior communications.
Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
Waiver: Our failure to enforce any provision of this Agreement does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights or obligations under this Agreement without our prior written consent.
Notices: Written notices under this Agreement should be sent to the contact details in Section 15.
14. Changes to These Terms
We may update these Terms from time to time. Changes take effect from the date they are published on this page. Continued use of our website or registration for any Offering after that date constitutes acceptance of the revised Terms. We will take reasonable steps to notify registered participants of material changes.
